Terms of Service

The agreement between your organisation and Code Infinity (Pty) Ltd for use of the Donor Management platform.

1. Acceptance

By creating an account or using the Donor Management platform, you agree to these Terms of Service. If you are accepting on behalf of an organisation, you confirm you have the authority to bind that organisation.

2. The service

Donor Management is a cloud-hosted platform for donor administration, Section 18A certificate issuance, and SARS IT3(d) submission preparation. Features vary by subscription plan; the current feature matrix lives on our Pricing page.

3. Accounts and access

  • You are responsible for keeping account credentials confidential.
  • Notify us immediately of any unauthorised use of your account.
  • We may suspend access to prevent abuse, protect other customers, or comply with a legal obligation.

4. Subscriptions and payment

  • Fees for each plan are shown on the Pricing page.
  • Subscriptions run month-to-month unless otherwise agreed in writing. Cancellation takes effect at the end of the current billing cycle. We do not pro-rate refunds for a partial month.
  • All amounts are in South African Rand (ZAR) and, where applicable, exclusive of VAT.

5. Your data

You retain ownership of every record you or your donors submit to the platform. We process that data on your behalf as an "operator" for the purposes of POPIA. See our Privacy Policy for detail on how we handle personal information.

6. Acceptable use

You agree not to:

  • Use the platform to send unsolicited bulk communication ("spam").
  • Attempt to reverse-engineer, disrupt, or gain unauthorised access to the platform.
  • Upload material that infringes third-party rights or violates South African law.
  • Issue tax-deductible certificates without holding a valid SARS PBO approval.

7. SARS submissions

The platform assists with the preparation and formatting of IT3(d) BRS files and Section 18A certificates. You remain responsible for the accuracy of the information submitted and for meeting SARS deadlines. Nothing in the service constitutes tax advice.

8. Third-party services

This website uses Google Analytics for visitor statistics and Google reCAPTCHA v3 to protect the Contact form from automated abuse. Both are subject to the Google Privacy Policy and Google Terms of Service. See our Privacy Policy for detail on what these services collect and how to opt out.

9. Availability and support

We aim for 99.5% monthly uptime and provide support during South African business hours. Planned maintenance windows are announced in advance. Enterprise plans may include additional SLA commitments as agreed in writing.

10. Limitation of liability

To the maximum extent permitted by South African law, our aggregate liability under these Terms is limited to the total fees paid by your organisation in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential loss.

11. Termination

Either party may terminate the subscription at the end of the current billing cycle. On termination, we make your data available for export for 30 days, after which it is permanently deleted.

12. Changes to these terms

We may update these Terms from time to time. Material changes will be notified by email and take effect no earlier than 30 days after notice. Continued use of the platform after that date constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the Republic of South Africa. Any dispute is subject to the exclusive jurisdiction of the South African courts.
